Other actions taken by the council included:

• Denying a special-use permit request to build a 300-foot cell tower at 118 Cratis Lane.

“I think we have a responsibility to these citizens that have the property 113 feet away to, even though they may have not made any objections in writing, or even verbally ... but I think we have a responsibility to protect them and their property value as a result of this tower being so close,” said Mayor Pro Tem Kelly Cmerek, explaining why he voted against approving the request.

• Approving the voluntary annexation of 163.25 acres at 1051 CR 401 into city limits. This land is between the Samsung factory and the Castlewood neighborhood and is part of a development called Taylor HQ, which is zoned as an employment center.

• Approving a change to a landscape plan at the Boxwood Two site development at 2002 W. Second St. An inspection by the city discovered the applicant removed some trees that were intended to be saved. Because the property cannot support all the trees required by the city’s code, the developer asked for a fee in lieu of the unfulfilled trees.

City staff recommended approving an amended landscape plan allowing fewer trees and assessing a $10,512 fee (the estimated cost of the missing trees). Council approved the new plan with fewer trees, but voted against charging the developer a fee.

• Approving a 100% roadway impact fee credit for the Park 79 development at 3500 W. Second St. The Park 79 project is constructing three large industrial buildings and also creating necessary infrastructure. The city has an ordinance allowing developments that construct roadway infrastructure to apply for a credit against their assessed roadway impact fees.

Park 79 is building a portion of 401 north of U.S. 79, which will be a city road. The amount of the credit approved was $2.1 million, which is less than the $2.5 million cost for the developer to build the road.
